Overview
Tucanos Brazilian Grill, LLC ("Tucanos") recognizes the importance of privacy to you and is firmly committed to protecting your privacy when you visit Tucanos websites, mobile applications, and online service or programs, (collectively "Tucanos Online Services"). As a result, we have instituted this privacy policy ("Privacy Policy"), This Privacy Policy applies to information about you that Tucanos may obtain when you access or use any of the "Tucanos Online Services". Tucanos is providing this notice to explain how we collect, use, disclose and protect the personal information that we collect from you in connection with your use of Tucanos Online Services. This Privacy Statement applies to the use and collection of data collected by Tucanos Brazilian Grill, LLC. This Privacy does not apply to offline data collection practices, with the exception of the California Consumer Privacy Act (CCPA) disclosures set forth in the "California Residents: Your Rights" section below.
As used in this Privacy Statement, "we" includes Tucanos and its affiliates, but does not include Tucanos franchisees. All third party vendors are required to maintain the confidentiality of the user information and are prohibited from using it for any purpose other than as described in this Privacy Statement. Tucanos franchisees ("Operators") own and operate their own individual franchised businesses. Tucanos licensees ("Licensees") are granted a license to use Tucanos trade name and marks in the sale of Tucanos products at Tucanos licensed locations. Operators and Licensees are independent third parties, and this Privacy Statement does not apply to the privacy practices of any Operator or Licensee.
By using Tucanos Online Services, you agree to the terms of this Privacy Statement and, if you provide us your personal information, you consent to the collection, use and disclosure of your information as described in this Privacy Statement. If you do not agree with this policy, please do not provide us any information and do not use Tucanos Online Services.
Tucanos is based in the United States, so any personal information we collect through Tucanos Online Services will be transferred to and maintained in the United States. By using Tucanos Online Services and/or providing us with your personal information, you understand and agree that your personal information will be transferred to the United States and subject to disclosures and uses in accordance with U.S. law as described in this Privacy Statement.
Registering with Tucanos Online Services
In order to use certain services provided through Tucanos Online Services, you may need to register with us, which will entail your disclosure and transmission of certain information about you. In connection with your registration, or at any time after registering, you may "opt-out" or unsubscribe from receiving any communications from us by following the unsubscribe instructions on the registration page, the Website or in any communication you receive from us or a third-party service provider acting on our behalf.
Information We Collect
Tucanos and its third-party service providers collect information about you from a variety of sources, including information you provide directly to us, and information we collect about you when you interact with us. For example, we and our third-party service providers collect information both directly and indirectly from you when you:
- access or use our websites, mobile applications, and online services or programs to review content including videos, where this Privacy Statement is posted or linked (collectively, “Tucanos Online Services”);
- create an account and/or provide personally identifiable information via Tucanos Online Ordering platform;
- order and/or purchase any of our products or services, such as ordering via Tucanos Online Ordering;
- contact or communicate with us;
- create an account with us;
- request information from us, such as submitting a catering request;
- register for any event or program, and/or participate in any event, program, contest, surveys, or other promotion that we may offer from time to time (collectively, “Promotions”);
- begin or complete the application process a franchise opportunity, or for employment by Tucanos;
- access or use Tucanos pages or accounts on any third-party social media platforms such as Facebook, Twitter, or Foursquare (“Social Media Pages”);
- sign-up for communications (e.g., email blasts, mobile notifications, text message (SMS) communications, or social media notifications) from us;
- provide or submit comments, stories, suggestions, or other content or input to us;
- interact with Tucanos Online Services via mobile, tablet or laptop device; and/or
- otherwise interact with us and Tucanos Online Services.
We may collect certain personal information provided by you ("Personal Information"), which may include your name, address, telephone number, e-mail address, birth date and/or age, and certain other personal, professional and demographic information about you.
When you use the fingerprint login features on your Apple or Android devices, we do not receive your fingerprint data. Your mobile phone’s authentication mechanism helps us verify that it is you.
Tucanos Online Services may also collect non-identifiable information that becomes available to us as a result of your visit to such service. This information includes, for example, your IP address (a number automatically assigned to your computer when you visit a Tucanos Online Service, and which is logged by our servers), your Internet Service Provider ("ISP"), your web browser, the type of operating system, the domain name of the website which links you to the Website, the pages you visited, the average time spent on the Website, and the products searched for.
Because we are very interested in the successful dissemination of information through Tucanos Online Services, we will review visitor trends recorded on certain log files. In connection with such log files, analysis software will be used to generate reports that will allow us to determine how we can enhance your experience with Tucanos Online Services. This information will not be used to ascertain your identity or the substance of what you are viewing or activity otherwise. The log files may be purged periodically, in our discretion, to maximize space on the server.
Transaction Data
We and our third-party service providers may also collect information, including Personal Information, relating to your purchases from Tucanos and its Operators and Licensees, such as the authorization code of the transaction, payment method, the date and time of the transaction, items purchased, and the purchase price ("Transaction Data").
Collection of Personally Identifying Information from or about Children
Tucanos does not knowingly collect or solicit personal information from anyone under the age of 18 or knowingly allow such persons to register. If you are under 18, please do not attempt to register or send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 18 may provide any personal information to Tucanos. Google Analytics
We use Google Analytics, a web analytics service provided by Google, Inc. ("Google") on Tucanos Websites. Google Analytics collects information such as how often you visit the Website, what pages you visit within the Website, and what other Websites you visited prior to coming to the Website. We use the information provided by Google Analytics to improve the Website. For more information regarding how Google collects, uses and shares your information please visit http://www.google.com/policies/privacy/partners/. Google provides users more choice on how their data is collected by Google Analytics by developing an Opt-out Browser Add-on which can be located at: http://tools.google.com/dlpage/gaoptout?hl=en. By installing this Add-on, no information is being sent to Google Analytics.
Do Not Track Notice and Consumer Choices
At this time, there is no worldwide uniform or consistent industry standard or definition for responding to, processing, or communicating Do Not Track signals. Thus, Tucanos Online Services do not currently respond to Do Not Track signals. You can exercise other choices available to you, including limiting the placement of browser cookies on your device using your browser's cookie control features as further discussed in the "Cookies" section below.
Third parties may collect Personal Information about an individual site visitor’s online activities over time and across different Web sites when a consumer uses the Site. For example, we use third party web analytics services on the Website, such as Google Analytics, to help us obtain and analyze information about your browsing or usage habits but this information does not include Personal Information other than your IP address. Mobile Applications
In addition to the information described above, we and our third-party service providers may collect additional information when you utilize any of our mobile applications, including the type of mobile device you use, the temporary or persistent unique device identifiers (sometimes called UDID), the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use our mobile applications.
If you utilize any of the location-based services available through our mobile applications and/or desktop platform (such as "Find a Restaurant"), we and our third-party service providers may collect, use, and share such location data, including the real-time geographic location of your device. We use such information to provide and improve location-based products and services. You may opt-out from further allowing us to have access to your location data by adjusting the permissions in your mobile device.
Use and Disclosure of Your Personal Information
The information we learn from visitors helps us personalize and improve Tucanos Online Services that we offer. We use your information to register you for various marketing and promotional programs, respond to your requests for information and to generate and maintain mailing lists. We may also share information with any third-party vendors we hire to assist in the administration of Tucanos Online Services, the collection, cataloging and/or analysis of data, and/or the processing or handling of any visitor transactions.
We may share any information collected through Tucanos Online Services with our affiliates, Operators or Licensees. Any entity or person that receives such information is required to adhere to this Privacy Statement.
We may also use your personal information for the following purposes:
- establishment and maintenance of our relationship with you;
- responding to your requests and inquiries;
- provide products and services to you;
- administering Promotions and other offers;
- meeting legal, regulatory, insurance, security and processing requirements; and
- otherwise with your consent.
SMS Short Code Texting (ClubTucanos):
Tucanos offers its customers a subscription to exclusive offers, coupons, and promotions over SMS. Enrollment requires providing a mobile phone number at sign up (for a ClubTucanos account on the mobile app or online). The mobile phone number's verification is done by sending an invitation text message, to which you must confirm by replying "YES". The invitation text message will notify you that you will receive recurring text messages. Message & data rates apply. Customers will be allowed to opt out of this program at any time. The text messages are sent using an automated system. Customers may receive up to four (4) messages per week. Customers are not required to opt in to receive text messages as a condition of purchasing any property, goods or services. Customers may also opt in to the program by texting "START" to 21241 from their mobile phone and then following same mobile verification instructions described above.

To Stop The Program: To stop the messages coming to your phone, you can opt out of the program via SMS. Text the word "STOP" to (21241) from the mobile phone number in which you wish to opt-out of the program. You'll receive a one-time opt-out confirmation text message.
If you want to join again, just sign up as you did the first time and we will begin sending SMS messages to you again.

In addition, we may share your personally identifying information with any third-party, without your consent or approval and without notice to you, (i) as permitted or required by law, (ii) as incident to a corporate sale, merger, reorganization, dissolution, bankruptcy or similar event, (iii) under circumstances we believe reasonably necessary to protect the personal safety of our employees, users of Tucanos Online Services, or the public, (iv) to disclose information that is necessary to identify, contact or bring legal action against someone who may be violating our published policies, (v) to operate Tucanos Online Services, or (vi) as is otherwise described in this Privacy Statement.
User Generated Content
Tucanos Online Services and Social Media Pages may allow users to post messages and submit their own content (e.g., stories, comments, blogs, postings, etc.), which may include Personal Information. You are responsible for all actions resulting from any information, including Personal Information, which you post on Tucanos Online Services or Social Media Pages. Please remember that any information you post becomes public information, is not subject to this Privacy Policy, and Tucanos is not responsible for the results of such postings.
Cookies
We from time to time use cookies on Tucanos Websites. Cookies are small text files that your web browser leaves on your hard drive to recognize you as a repeat user of the Website, track your use of the Website and target advertising. This allows for personalization of certain aspects of your visit to the Website. Information gathered from cookies in this way is only used on an aggregate basis. This Privacy Statement does not apply to any Linked Websites. We have no control over the collection or use of information, including Personal Information, on any Linked Website. We encourage you to read and understand the privacy policies of any Linked Websites that you visit. Operators and Licensees are independent third parties and may own, operate, and maintain a website, mobile application, social media page, or other online service for his, her, or its franchised or licensed restaurant business ("Operator or Licensee Online Services"). This Privacy Statement does not apply to the privacy practices of any Operator or Licensee. Right to Know About Personal Information Collected, Disclosed, or Sold
You have the right to request that Tucanos disclose certain information to you about our collection, use, disclosure and sale of your personal information over the past twelve (12) months. Once we receive and confirm your request, to the extent you have requested them, we will disclose to you:

Exercising Your Rights to Know and Deletion

In order to submit a consumer request, a consumer must submit an email request or call the toll-free telephone number and provide following information, first and last name, address, phone number, email address, and the information requested. Once submitted the consumer will be contacted and may be required to provide additional information related to the account for verification purposes only.
Only you, or someone legally authorized to act on your behalf (i.e., your authorized agent), may make a request related to your personal information. Tucanos may require an agent to provide verification that they are acting on your behalf when they submit a request related to your personal information.
Non-Discrimination
Tucanos will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:
- Deny you services.
- Charge you different prices or rates for services, including through granting discounts or other benefits, or imposing penalties.
- Provide you a different level or quality of services.
- Suggest that you may receive a different price or rate for services or a different level or quality of services.
